Rubbish Removal Lambeth Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Lambeth provides waste collection and rubbish clearance services to domestic and commercial customers. By making a booking, accepting a quotation, or allowing our team to carry out work at your property, you agree to be bound by these Terms and Conditions.
If you do not agree with any part of these Terms and Conditions, you should not place an order or proceed with a booking for our rubbish removal services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below.
Customer means the person, company, or organisation requesting rubbish removal or waste collection services from Rubbish Removal Lambeth.
Services means any rubbish removal, waste collection, clearance, loading, transport, disposal, or related services that we provide.
We, us, our means Rubbish Removal Lambeth, the service provider supplying the Services.
Waste means any items, materials, rubbish, or refuse that the Customer asks us to remove, excluding any prohibited or hazardous items where we have not agreed in writing to handle them.
Booking means a confirmed request by the Customer for Services on a specified date and, where applicable, at a specified time.
2. Scope of Services
We provide rubbish removal and waste collection services for households, landlords, letting agents, offices, retail premises, and other commercial or domestic sites. Our services typically include loading, removal, and lawful disposal or transfer of non-hazardous waste.
The exact scope of each job will be based on the description given at the time of enquiry and as set out in any quotation we issue. Any additional work requested on site may result in changes to the price and timing of the Services.
We reserve the right to refuse to remove any items that are unsafe to handle, not as described at the time of booking, or fall within prohibited categories under waste regulations, unless special arrangements have been agreed in advance.
3. Booking Process
3.1 Bookings may be made by telephone, email, or through any other contact method we make available. Each Booking is subject to these Terms and Conditions.
3.2 When making a Booking, you must provide accurate information about the type and volume of waste to be removed, the property access conditions, parking availability, floor level, presence of lifts, and any other relevant details that may affect the time or resources required.
3.3 We may provide an estimated price based on your description or, where necessary, arrange a site visit before confirming the final quotation. All quotations are given in good faith but are subject to change if the information provided proves to be incomplete or inaccurate.
3.4 A Booking is only considered confirmed once we have accepted your request for Services and, where applicable, you have accepted our quotation. Confirmation may be provided verbally or in writing.
3.5 We will use reasonable efforts to attend at the agreed date and, if stated, within the agreed time window. However, attendance times are estimates and may be affected by traffic, weather, operational issues, or circumstances beyond our control.
4. Access and Parking
4.1 The Customer is responsible for ensuring safe, reasonable access to the property or area where the waste is located, including any necessary permissions from landlords, managing agents, or neighbours.
4.2 The Customer must arrange suitable parking for our vehicle, including any permits or visitor passes where required. Any parking charges, congestion charges, or similar fees incurred while carrying out the Services may be added to the final invoice.
4.3 If we are unable to access the site or cannot safely carry out the work due to inadequate access, obstructed areas, or unsafe conditions, we may cancel or postpone the job and charge a call-out or cancellation fee.
5. Customer Obligations
5.1 The Customer must ensure that the waste to be removed is clearly identified and separated from any items that are to be retained.
5.2 The Customer warrants that they either own the waste items or have full authority from the owner to request their removal and disposal.
5.3 The Customer must inform us in advance of any items that are hazardous, heavy, delicate, or may require special handling, as well as any known risks or dangers at the property.
5.4 The Customer must be present, or arrange for an authorised representative to be present, at the agreed time to provide access, confirm the items for removal, and sign any required documentation, unless we have agreed an alternative arrangement in advance.
6. Waste Types and Regulations
6.1 We operate in compliance with applicable UK waste management and environmental regulations. All collected waste will be transported to licensed facilities for recycling, recovery, or disposal, as appropriate.
6.2 We generally accept non-hazardous household and commercial waste, including furniture, appliances, general rubbish, and light construction debris. However, some items may be restricted, require prior notice, or attract additional charges.
6.3 Prohibited or restricted items may include, but are not limited to, asbestos, gas cylinders, certain chemicals, clinical or medical waste, large quantities of paint, solvents, and other hazardous materials. If such items are discovered on site without prior disclosure, we may refuse to remove them and may charge for any additional time incurred.
6.4 Where we agree to handle or arrange collection of items that fall under specific regulatory schemes, such as electrical equipment, batteries, or certain producer responsibility arrangements, we may require additional information from the Customer and may apply supplemental charges.
6.5 The Customer must not knowingly include in the waste any items that are illegal to possess, transport, or dispose of. We reserve the right to notify the relevant authorities if we suspect that any such items are present.
7. Pricing and Quotations
7.1 Our pricing may be based on one or more of the following factors: volume of waste, weight, type of materials, time spent on site, ease of access, labour required, and disposal or tipping fees.
7.2 Quotations are usually provided as either fixed prices or estimates. Where an estimate is given, the final price may vary depending on the actual volume and nature of waste collected and the time taken to complete the job.
7.3 If, upon arrival, we find that the actual waste or working conditions differ significantly from those described at the time of Booking, we may adjust the price accordingly. We will inform you of any change in price before commencing or continuing the work, and you may choose whether to proceed.
7.4 All prices are stated exclusive of VAT unless expressly stated otherwise. If VAT is applicable, it will be charged at the prevailing rate at the time of invoicing.
8. Payment Terms
8.1 Unless otherwise agreed in writing, payment is due in full upon completion of the Services on the same day.
8.2 We may accept payment by cash, bank transfer, card, or other methods that we notify to you. We do not accept cheques unless explicitly agreed in advance.
8.3 For business customers or larger jobs, we may require a deposit or full prepayment prior to commencing work. Any such requirement will be communicated to you at the time of Booking or quotation.
8.4 If payment is not received when due, we reserve the right to charge interest on overdue amounts at the statutory rate and to recover from you all reasonable costs incurred in pursuing payment, including debt collection and legal fees.
8.5 Title to any items with potential resale or scrap value that we remove as part of the Services will transfer to us upon collection, unless otherwise agreed in writing. No credit is normally given for such items, unless specifically stated.
9. Cancellations and Rescheduling
9.1 You may cancel or reschedule a Booking by giving us reasonable notice before the scheduled arrival time. We ask that you provide at least 24 hours notice wherever possible.
9.2 If you cancel a Booking with insufficient notice, or if we attend the property and are unable to proceed with the work due to reasons within your control, we may charge a cancellation fee or minimum call-out charge.
9.3 We reserve the right to cancel or reschedule a Booking at any time if we are unable to perform the Services for reasons outside our reasonable control, including vehicle breakdown, extreme weather, staff illness, or safety concerns. In such cases, we will aim to offer a new appointment as soon as reasonably possible, but we will not be liable for any indirect loss arising from such cancellation.
10. Liability and Limitations
10.1 We will carry out the Services with reasonable care and skill. However, we accept liability only to the extent set out in this clause and otherwise to the extent required by law.
10.2 While working on your property, we will take reasonable care to avoid damage. Minor scuffs or marks sometimes occur when removing bulky items from confined spaces, and we will not be held liable for such minor cosmetic damage.
10.3 We will not be liable for any damage or loss where access routes are narrow, awkward, or require us to take items through areas not suited for moving large objects, particularly where you have requested or insisted on removal through such areas.
10.4 You must notify us of any damage that you believe has been caused by our team as soon as reasonably practicable and, in any event, within 48 hours of completion of the Services. We may request evidence and the opportunity to inspect the alleged damage.
10.5 We shall not be liable for any loss of profits, business interruption, loss of data, loss of opportunity, or any indirect or consequential losses, whether arising in contract, tort, or otherwise.
10.6 Our total liability to you in respect of all claims arising out of or in connection with the Services shall be limited to the total amount paid or payable for the relevant Booking, except where such limitation is not permitted by law.
10.7 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other matter where liability cannot be excluded or limited under applicable law.
11. Customer Property and Items Left Behind
11.1 It is your responsibility to ensure that no items you wish to keep are mixed with the waste prepared for removal. Our team will generally remove what they have been instructed to take and may not be able to distinguish between waste and valuables.
11.2 We accept no liability for any items that are removed and disposed of as waste where those items were not clearly separated or identified as not for removal at the time of the job.
11.3 Once waste has been removed and transferred into our vehicle, it cannot normally be retrieved. Any attempt to recover items after loading may incur additional charges and may not always be possible.
12. Complaints
12.1 If you have any concerns or complaints about our Services, you should contact us as soon as possible, providing your name, address, contact details, and details of the issue.
12.2 We will investigate your complaint and aim to respond within a reasonable timeframe. Where appropriate, we may propose remedial action, a partial refund, or other resolution at our discretion.
13. Data Protection and Privacy
13.1 We will collect and process personal information about you for the purposes of handling enquiries, managing Bookings, providing the Services, taking payment, and maintaining our business records.
13.2 Your information will be kept secure and will not be sold to third parties. We may share information with third parties only where necessary to perform the Services, process payments, or comply with legal obligations.
14. Amendments to Terms
14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulatory requirements, or our business practices.
14.2 The version of the Terms and Conditions that applies to your Booking will be the version in force on the date you make the Booking. We recommend that you review the Terms and Conditions periodically to stay informed of any changes.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Rubbish Removal Lambeth.
16. General Provisions
16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
16.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.
16.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where this does not reduce the level of service or protection afforded to you.
16.4 These Terms and Conditions constitute the entire agreement between you and Rubbish Removal Lambeth in relation to the Services and supersede any prior understandings or agreements, whether written or oral.
